This agreement is between the customer whose details are set out in the "Booking contact name" located on the ‘book now’ section of the accommodation online booking form attached to these terms and conditions (You) and Asdoo.com Pty Ltd (Asdoo.com). By clicking the "Purchase now" button in the online form to which these terms and conditions are attached, You acknowledge that You have read this agreement, understand it and agree to be bound by its terms and conditions.
Definitions
In this agreement:
Accommodation Services means the provision of accommodation described on the Website.
Accommodation Service Fees means the fees displayed on the Website for the provision of the Accommodation Services (but for the avoidance of doubt, does not include the Booking Fee or any relevant Surcharge).
Administration fee means the amount set out on the booking page of the Website where a change, amendment or cancellation of a confirmed booking is accepted by a Supplier.
Booking Fee means the amount set out on the booking page of the Website.
Booking Service means the service of receiving any booking information provided by You for Accommodation Services via the Website and submitting that information electronically to the Supplier, along with the service of accepting payment from You for those Accommodation Services, and passing the Accommodation Services Fees payments to the Supplier, subject to the terms and conditions of this agreement.
Property means the venue or property owned or operated by the Supplier from which the Accommodation Services are provided.
Supplier means the provider of the Accommodation Services.
Surcharge means a charge of 2% of the total of the Accommodation Services Fees and the Booking Fees in relation to any payments made by American Express or Diners cards.
Website means the websites used from time to time by Asdoo.com to provide the Booking Service.
Asdoo.com Obligations
1. Asdoo.com will provide the Booking Service upon receipt of payment in accordance with the "Payment" terms and conditions set out below.
Customer Obligations
2. The person entering this agreement (and if You are a corporation, the person entering into this agreement on Your behalf) must be at least 18 years old and possess the legal authority to enter into this agreement. Should Asdoo.com suffer any damages or other losses as a result of a transaction entered by a minor, Asdoo.com reserves the right to seek compensation for such losses from the credit card holder who caused or assisted in any booking(s) to be placed with Asdoo.com.
3. Your booking obligation is to ensure that You keep Your personal details (telephone contact, email address) current up to 3 days prior to the date of the accommodation booking.
4. You will be required to provide positive proof of identification (valid driver’s license or valid passport), which will be recorded at check-in by the Supplier, to match the guest name as it appears on the Asdoo.com email confirmation, guest folio and credit card.
5. Travel insurance is not included in any prices advertised by Asdoo.com. Asdoo.com strongly recommends that You purchase travel insurance to cover Yourself against loss of monies paid in the event of having to cancel a booking due to illness or other unforeseen circumstances.
6. You must not:
(a) link to any part of the Website, without Asdoo.com's prior written consent;
(b) use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction or process being conducted on or through it; or
c) take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website.
7. When booking through Asdoo.com You may use the free text comments box and/or check box to submit any special requests. Asdoo.com encourages Suppliers to meet reasonable requests, but cannot guarantee that a Supplier will honour every special request.
Payment
8. By entering into this agreement, You authorise the following fees to be debited from any of the credit card details You provide to Asdoo.com, or if those details do not allow the fees to be fully debited, the details You provide to the Supplier:
(a) the Booking Fee;
(b) any relevant Surcharge; and
(c) the Accommodation Service Fees.
9. Once payments from Your credit card have been released to Asdoo.com, Asdoo.com will confirm Your booking, and provide a tax invoice via email to the email address notified by You on the booking page of the Website.
10. You will be required to provide a valid credit card or cash deposit (as required by the Supplier) as pre-authorisation at check-in. The pre-authorised amount or cash bond may be taken (the amount will be set by the Supplier) to cover incidental charges not included in Your selected package (for example room service, parking, telephone and television charges, mini-bar and additional guest charges).
11. Asdoo.com’s Booking Fee is non-refundable.
12. Asdoo.com is not commissionable in respect of its offers to registered travel agents, and professional conference organisers.
13. Asdoo.com receives a payment from Suppliers for the provision of the Booking Service.
14. The Supplier from whom You have booked Accommodation Services will display their cancellation policy on the Website ("choose your room" and "book now") pages.
Where the Supplier allows a Cancellation Period, and You cancel Your Accommodation Services:
(a) before the Cancellation Period (the stated allowable cancellation hours prior to 6pm check-in time), You will receive a refund for the Accommodation Services Fee, minus the Booking Fee and administration fee; or
(b) within the Cancellation Period (within the stated allowable cancellation hours prior to 6pm check-in time), You will be liable for the full amount of the Accommodation Services Fee, plus the Booking Fee and any Surcharge payable.
Where the Supplier does not allow a Cancellation Period, and You cancel Your Accommodation Services, You will be liable for
(a) the first night’s full amount of the Accommodation Services Fee as displayed on the Supplier’s cancellation policy, plus the Booking Fee and any Surcharge payable; or
(b) the full amount of the Accommodation Services Fee as displayed on the Supplier’s cancellation policy, plus the Booking Fee and any Surcharge payable.
15. You may request a variation of the Accommodation Services by telephoning Asdoo.com using the contact us details, and although Asdoo.com will pass that request to the Supplier, the Supplier may, in its sole discretion, accept or reject the requested variation, and You agree that You will not make any claim against Asdoo.com regarding the exercise of the Supplier’s discretion.
16. If the Supplier approves a variation of Your booking, Your Accommodation Services Fee will be adjusted accordingly, and will be notified to You via email confirmation. You may also be charged an administration fee by Asdoo.com for the variation, and You agree to pay this administration fee via a debit from any refund payable to You, or via a separate debit to Your credit card.
Liability
17. Subject to any warranties or responsibilities implied by law and which cannot be excluded, Asdoo.com, and its directors, employees, agents and contractors, are not liable to You for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever, whether direct, indirect or consequential, arising out of or referable to the Booking Services provided by Asdoo.com through the Website, any material on this Website, any third party material, or access to the Website by You, howsoever caused, whether in contract, tort including negligence, statute or otherwise.
18. To the extent permitted by law, Asdoo.com makes no warranty or representation about the fitness or suitably of any product or service displayed on its Website.
19. The liability of Asdoo.com for breach of a condition or warranty implied by law, and which cannot be excluded, is limited, to the extent possible and at Asdoo.com's option, to the supply of the goods or services again, the repair of the goods, or the payment of the cost of having the goods or services supplied again or repaired.
20. Although Asdoo.com endeavours to ensure that all the information relating to the Accommodation Services (such as packages, rates, availability of Accommodation Services, and images) and appearing on the Website is current, accurate and free from error or omissions, that information is not generated by Asdoo.com, and to the extent permitted by law, Asdoo.com cannot and does not warrant that this information is correct, and the use of that information is entirely at Your risk.
21. To the extent permitted by law, Asdoo.com does not warrant that the Website, or any third party websites will be free from viruses, or that access to those websites will be uninterrupted. Access to the Website is provided to You on an "as is" basis.
22. If for any reason the Supplier is unable to provide the Accommodation Services for which You have paid, or You otherwise suffer any loss, damage or cost due to the acts or omissions of the Supplier, and to the extent permitted by law Your claim lies against that Supplier, not against Asdoo.com, and You hereby irrevocably waive and release Asdoo.com from any liability relating to the same. As the payment has been made to Asdoo.com by credit card, You agree that You will not seek to charge back Your payments to Asdoo.com.
23. Asdoo.com shall not be responsible for any actions or omissions on the part of the Supplier, which results in any loss relating to merchandise or materials, damage, delay or injury to You or Your associates. Asdoo.com will not be responsible for any events of "force majeure" (ie those beyond Asdoo.com’s control).
Indemnity
24. You indemnify and hold harmless Asdoo.com in respect of all liability incurred by Asdoo.com for any loss, damage, cost or expense, howsoever caused, suffered or incurred by Asdoo.com as a result of Your breach of this agreement, or Your use of the Website or any material on this Website.
Intellectual Property
25. You acknowledge and agree that all material on, and comprising, the Website (including its operation, code, architecture and implementation as well as the look and feel of the software that is used in the operation of the Website, but excluding any information provided by any Suppliers relating to the Accommodation Services) is the valuable intellectual property of Asdoo.com.
26. Your rights to use the software associated with operating the Website, and the data contained within the Website, are strictly limited to downloading a copy of the Website to the local hard drive of Your computer used to access the Website, and printing extracts of the Website, for Your personal use.
27. You acknowledge and agree that nothing in this agreement in any way assigns any intellectual property rights owned by Asdoo.com in the Website, or the material on the Website, to You, and that You have no right to modify, translate, disassemble, disseminate, decompile, reverse engineer, create derivative works of, or make any other attempt to discover or obtain the source code for the software that operates the Website. You are not permitted to copy any of the material on the Website or otherwise incorporate or store it into any other website, electronic retrieval system, publication or other work in any form, or provide a link to the Website unless otherwise specified in this agreement, or with Asdoo.com’s prior written consent.

General
29. Asdoo.com needs to collect information about You to process Your booking. Once You have made Your booking, Asdoo.com will provide Your information (excluding credit card details and email address) to the Supplier so they can process Your booking. Please refer to our privacy policy for further information.
30. The Supplier may have specific policies relating to their Property that are displayed on the Website, and You agree that You will comply with them when You register with the Supplier.
31. The parties agree that this agreement will be governed by the laws of the State of Queensland, Australia.
32. The parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia and the courts of appeal from them, for determining any dispute concerning this agreement or the transactions contemplated by it, and the parties waive any right they have to object to an action being brought in those courts.
33. Should any clause or part thereof of this agreement be found to be void, unenforceable or invalid, then it is severed from this agreement, leaving the remainder in full force and effect, provided that the severance has not altered the basic nature of this agreement.
